Jurnal Hukum Kenotariatan Otentik's merupakan jurnal yang memuat artikel-artikel mengenai hukum kenotariatan. Jurnal ini diterbitkan oleh Program Studi Kenotariatan Program Magister Universitas Pancasila, dan dimaksudkan untuk menjadi media pengembangan dan penyebarluasan pemikiran di bidang hukum kenotariatan. Abstract

A notary, both as a public official and as a person who is trusted for his mandate, must uphold the confidentiality of his position, including legal deeds and documents and all information he or she obtains in the process of drafting such deeds and documents, as regulated in Article 19 paragraph (1) point (f) of the UUJN/2014, and as stated in the notarial oath. The confidentiality of his or her position can be revoked if he or she shares a copy of the deed or make official statements in relation to the deed to and by the request of law enforcement officers, including Investigator, Prosecutor, and Judge. This can result in a notary being disbarred as regulated in Article 16 paragraph (11) of the UUJN/2014, or even imprisoned as regulated in Article 322 paragraph (1) of the Criminal Code, except when the privilege is revoked due to legal orders and is carried out by the notary for the common good and law enforcement process, while still upholding the oath and the rights to confidentiality (denial rights and renunciation of Notary). In line with such reality, the Notary Honorary Council (MKN) will determine whether they approve or disapprove the request for a copy of the deed and/or all relevant information as stated in the request from Investigator, Prosecutor, Judge to MKN. However, before MKN makes any decisions, they should conduct an examination of the notary as a form of legal protection for MKN against the confidentiality of the notary’s position, concerning the contents of the deed and all information/ statements obtained by the notary from the parties entrusting him in the making of the deed.

Abstract

Alternative dispute resolution is a dispute resolution mechanism that offers advantages compared to disputes resolving through a court mechanism. Now, international business activities are more complex, and there are also many potential disputes among business people. Therefore, the existence of a dispute resolution mechanism is important to provide, especially a more effective and efficient dispute resolution mechanism. Now the mechanism contained in the Dispute Resolution Alternative is more diverse, including the mechanisms of consultation, conciliation, negotiation, mediation, arbitration, and even online arbitration. Unfortunately, Indonesia, through Law No. 30 of 1999, still cannot respond to the needs and existence of the online arbitration.

Abstract

Fee for acquisition of right of land and building (BPHTB) is a central tax that diverted into the local tax as provided in Law No. 28 of 2009. For BPHTB collection purpose, local government shall establish regional regulation concerning BPHTB. Based on that, then the Bogor Government issued Law No. 15 of 2010 on BPHTB. The collection of BPHTB, since 2011, was transferred to Local Revenue Office of Bogor. For such collection, then the office also issued a regulatioan on field verification of land and building subjected to collection of BPHTB. Field Verification aims to examine the correctness and to investigate the validity of tax object and documents received with actual field condition, especially on matters relating to the sale price of the land and building which are transacted.

Abstract

This research aims to explain the transfer process of rights of communal land of Ifar Besar Sentani Tribe for the construction purpose of Main Class I Sentani Airport, Jayapura, Papua, and also to explain the influence of customary law that arises when the communal land diverted for the benefit of the public. This research uses empirical juridical research method. Transfer of rights of communal land of Ifar Besar Sentani Tribe for public interest or purpose, in the case of the construction of runway extension Sentani Airport, is not resolved yet due to the factor or influence from the indigenous law of Ifar Besar Sentani Tribe.

Abstract

The legal status of state-owned enterprises (BUMN) cannot be separated from the state finance conception. In addition to the dualism of legislation that applies with regard to state finances, there are also intersections between private law and public law. The use of a civil action mechanism, internal supervision and the application of the private law domain to state-owned enterprises based on the Limited Liability Company Law on indications of mismanagement of state-owned enterprises, so that the Directors of BUMN may be criminally responsible for the losses of state-owned enterprises. The judicial review of the Supreme Audit Board (BPK) law is based on the view that the state's financial scope is only the state budget, while the state's assets outside the state budget, such as the assets separated from state-owned enterprises are not state finances. The issue of the constitutionality of the BPK's authority in examining state financial management carried out on state-owned enterprises is deemed inconsistent with the objectives of BUMN which are expected to be independent, prioritizing the principles of good corporate governance, even though the Constitutional Court in Decision Number 48 and Number 62/PUU-XI/2013 rejected the application and the BPK still has the authority to supervise state-owned enterprises.
